2. Scope of Application

These General Terms and Conditions apply to all purchases made through the website www.filadelfio.com by consumers.

By placing an order through the website, the customer confirms that they have read, understood, and accepted these Terms and Conditions.

Personal data is processed in accordance with the Privacy Policy and Cookie Policy, available on this website and accessible through the links provided in the website footer.

3. Products

Filadelfio produces handcrafted ceramic sculptures and decorative artworks.

Due to the artisanal nature of the production process, each piece is individually handmade and therefore unique.

Small variations in color, glaze, texture or shape may occur. These characteristics are inherent to the handmade process and contribute to the individuality of each piece.

Such characteristics do not affect the consumer’s statutory rights under the legal guarantee of conformity provided by applicable law.

Product images are provided for illustrative purposes. Slight differences may occur between the images displayed online and the final product.

Additionally, due to differences in screen settings and lighting conditions, colors may appear slightly different on screen.

Customers may request additional photographs, videos or specific measurements prior to purchase by using the contact form available on each product page.

Customers with specific spatial or dimensional requirements are encouraged to contact us before placing an order.

4. Prices

All prices displayed on the website are expressed in Euros (€).

Prices include VAT where applicable, unless otherwise specified.

Shipping costs are calculated separately and displayed during checkout.

For shipments outside the European Union, customs duties, taxes or import charges may apply and are the responsibility of the customer.

In the event of price reductions, the website will indicate the lowest price applied in the 30 days preceding the discount, in accordance with applicable consumer protection law.

5. Order Process

To place an order, the customer must:

  1. select a product;

  2. add the product to the shopping cart;

  3. proceed through the checkout process;

  4. confirm the order.

Before submitting the order, customers will be able to review and correct any errors in the information entered during the checkout process.

Once the order has been submitted, the customer will receive an order confirmation email acknowledging receipt of the order.

The order confirmation email will be sent to the customer on a durable medium (email) and will include a PDF attachment containing a copy of these Terms and Conditions.

The confirmation email will also contain a summary of the order including:

  • the details of the order;

  • the purchased products;

  • the total price of the order, including shipping costs;

  • information regarding the right of withdrawal;

  • information regarding the legal guarantee of conformity.

The contract between the seller and the customer shall be considered concluded when the seller sends the order confirmation email.

The contract will be archived electronically by the seller.

Customers may request access to the archived contract by contacting the seller using the contact details provided on the website.

The contract may be concluded exclusively in the English language.

6. Payment Methods

Accepted payment methods include:

  • Bank Transfer

  • PayPal

For bank transfers, payment must be completed within 5 working days.

Orders will be processed only after payment has been received.

7. Shipping and Delivery

Orders are shipped via national or international courier.

Products are carefully packaged using protective materials suitable for fragile artworks.

Delivery times depend on the destination country and courier service.

Unless otherwise agreed, goods will be delivered within 30 days from the conclusion of the contract.

In accordance with consumer protection law, the risk of loss or damage to the goods passes to the consumer only when the consumer (or a third party designated by the consumer) physically receives the goods.

8. Legal Guarantee of Conformity

Consumers are entitled to the legal guarantee of conformity provided by applicable law.

The seller is liable for any lack of conformity that becomes apparent within two years from delivery of the goods.

For defects that appear within one year from delivery, the defect is presumed to have existed at the time of delivery unless proven otherwise.

In case of lack of conformity, the consumer has the right to:

  1. repair or replacement of the product free of charge

  2. if these remedies are impossible or disproportionate, a price reduction or termination of the contract.

9. Right of Withdrawal

Consumers have the right to withdraw from the purchase within 14 days from delivery.

To exercise this right, the consumer must notify the seller in writing.

The seller will reimburse all payments received from the consumer, including the standard shipping costs.

Return shipping costs are borne by the consumer unless otherwise required by law.

The consumer is only responsible for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature and characteristics.

The seller may withhold reimbursement until the returned goods are received.

10. Custom or Personalized Products

For products that are made to the consumer’s specifications or clearly personalized, the right of withdrawal does not apply, as provided by applicable consumer protection law.

This exclusion will be clearly indicated before purchase when applicable.

11. Intellectual Property

All content on the website, including:

  • images

  • texts

  • designs

  • artworks

  • logos

is the intellectual property of Filadelfio and protected by copyright law.

Unauthorized reproduction or commercial use is prohibited.

12. Limitation of Liability

Filadelfio shall not be liable for indirect damages such as loss of profit.

Nothing in these Terms shall limit or exclude liability for intentional misconduct (dolo) or gross negligence (colpa grave), nor limit consumer rights provided by mandatory law.

13. Privacy

Personal data is processed in accordance with the Privacy Policy and Cookie Policy, available on the website.

14. Authenticity and Craftsmanship

All products sold on this website are designed and handcrafted in Sicily, Italy.

Each piece is individually produced by Filadelfio. Small variations in form, glaze or texture are inherent to the handmade process and contribute to the authenticity and uniqueness of each work.

15. Governing Law and Dispute Resolution

These Terms are governed by Italian law.

For consumers resident in Italy, jurisdiction lies with the court of the consumer’s place of residence or domicile.

Consumers may also attempt to resolve disputes through Alternative Dispute Resolution (ADR) bodies available under Italian law.
